1.      Purpose

 

1. 1 This Agreement establishes a legal agreement between you (referred to as "you") and Reggi & Co, a company with its registered office at 33, boulevard Carnot 59000 Lille, registered in the Lille Trade and Companies Register under number 820 177 301 (hereinafter referred to as "REGGI", REGGI", "we", "us" or "our"), which DUNS number is 280789743, with respect to the use of our applications available on the App Store and Google Play (hereinafter referred to as the "Game" or "Games") and any associated services (the "Services").

By using our Services, you agree to be bound by these terms and conditions and by our privacy policy (hereinafter referred to as the "Privacy Policy") (see paragraph 10 below).

 

1.2 You certify that you are at least 12 years old. If you are between the ages of 12 and 18, you warrant that your legal representative has read and accepted these terms and conditions and has granted you permission to access and/or use our Services.

 

1.3 These conditions are permanently accessible at www.reggi-games/cgu. We reserve the right to modify these terms at any time, in accordance with paragraph 14 below, and your continued use of our Services following any update to the terms constitutes your acceptance of the new version.

 

 

2.      Use of our Services

 

2.1 The guidelines, controls and recommendations specific to each Game can be consulted directly in the Game concerned. These systems, rules, orders, and recommendations are incorporated into these Terms, and you agree to comply with them when accessing and/or participating in a Game.

 

2.2 You are responsible for any Internet connection and/or mobile service charges you may incur when accessing and/or using our Services. If you are unsure about these charges, please consult your Internet service provider or mobile operator before accessing and/or using our Services.

 

2.3 We reserve the right to discontinue or modify our Games or any part of our Services (in whole or in part), at any time, without any liability to you, for a variety of reasons, including:

 

- Technical reasons, such as technical difficulties encountered by us or related to the Internet.

- Improving the user experience.

- Legal reasons, such as privacy or other legal objections related to the content or conduct of our Games or Services.

- Lack of profitability in the provision of the Game or Service concerned.

- Changes to our services.

 

2.4 Our Services may also be unavailable from time to time, in whole or in part, whether planned or unplanned, for a variety of reasons, including technical or maintenance operations.

 

2.5 The price charged for the Premium version of one of our Games is the price displayed at the time of purchase. This price includes all taxes. Our partners may impose their own terms of use, so it is advisable to consult them before deciding whether or not to accept the terms prior to any payment. If the transaction is not validated by our partners, your purchase will not be taken into account.

 

2.6 It is possible to subscribe to our application to benefit from Premium features and unlimited content. Prices are subject to change without notice. Promotional rates may occasionally be offered for purchases made during the promotional period. Due to the urgent and promotional nature of these events, we are unable to offer retroactive discounts for previous purchases in the event of a price reduction or promotional offer. Payment will be debited upon confirmation of purchase, and the subscription will renew automatically, unless automatic renewal is deactivated at least 24 hours before the end of the current period. The account will be debited for renewal within 24 hours of the end of the current period. Subscriptions can be managed by the user and automatic renewal deactivated by accessing Apple or Google account settings.

 

 

3       User behavior

 

3.1 You must comply with the laws in force in the territory from which you access our Services. If any laws restrict or prohibit your use of our Services, you must comply with such restrictions or cease accessing and/or using our Services.

 

3.2 You warrant that the information you provide, if any, when accessing and/or using our Services is true, accurate and complete at all times.

 

3.3 You agree not to:

- Use our Services to harm, shock or harass third parties.

- Use our Services for fraudulent or abusive purposes.

- Use our Services for commercial or professional purposes for the benefit of third parties or to send unsolicited communications.

- Delete or alter any legal notices or other proprietary information contained in our Games or any other part of our Services.

- Interfere with or disrupt our Services, servers or networks providing our Services.

- Attempt to reverse-engineer, decompile or hack our Services, circumvent or defeat any encryption technologies or security measures applied to the data we transmit, process or store.

- Violate the obligations or regulations of any network connected to our Services.

- Use our Services in a manner contrary to applicable laws or regulations.

- Use our Services in any way not expressly permitted in these Terms.

 

3.4 We reserve the right to remove content linked to our Services if we consider, in our sole discretion, that it causes or results from a total or partial breach of these terms, or that it is likely to damage our reputation or that of our Services.

 

 

4       Intellectual property rights

 

4.1 It is agreed that all copyrights, trademarks and other intellectual property rights in our Services are owned by or licensed to us.

 

4.2 You may not, without our prior written consent, copy, distribute, publicly perform or create derivative works from all or any part of our Services.

 

 

5       Privacy Policy

 

5.1 We do not collect, process, use or share your personal information within the scope of our Privacy Policy (see below).

 

5.2 No personal information is requested from you in order to use our Services.

6       Adjustment of these terms

 

6.1 These Terms set out the entire agreement between you and us in relation to our Services (as defined in paragraph 1). They supersede any prior agreements and understandings between you and us in this regard.

 

6.2 We may transfer any or all of our rights and obligations under these Terms to third parties without your consent. Without our prior written consent, you may not transfer any or all of the rights granted to you under these terms and conditions.

 

6.3 You can view these terms and conditions at any time at www.reggi-games/cgu. We reserve the right to update these terms and conditions at any time by posting a new version at the above address. We may do so because we change the nature of our products or services, for technical or legal reasons, or because the needs of our business have changed, or for any other reason at our sole discretion. You agree that if you do not agree to any changes to our terms, you must immediately stop using our Services.

 

6.4 If any provision of these Terms is held to be invalid or unenforceable under applicable law or in the opinion of a court of competent jurisdiction, such provision shall be construed in a manner consistent with applicable law, reflecting as closely as possible its original intent, and the remaining provisions shall remain in full force and effect.

 

 

7       Disputes

 

7.1 These General Terms and Conditions of Use are governed by and shall be construed in accordance with the laws of France.

 

7.2 In the event of a dispute, the parties undertake to negotiate in good faith in order to resolve the dispute amicably. If no amicable resolution is reached within a reasonable period of time from written notification of the dispute by one party to the other, each party retains the right to institute legal proceedings.

 

7.3 All disputes will be submitted to the exclusive jurisdiction of the Lille Court (France).
